Head of Compliance Real Estate Europe

The role will be responsible for all compliance matters relating to the European Real Estate business across Europe. The German part of the business operates from Munich and is currently unregulated. The business has identified a commercial and regulatory requirement for German real estate business become regulated - it may also provide portfolio management services as a delegate pursuant to AIFMD and for this reason it would also need to become regulated.

Job Purpose (Job Summary): The role will be responsible for all compliance matters relating to the European Real Estate business across Europe. The German part of the business operates from Munich and is currently unregulated. The business has identified a commercial and regulatory requirement for German real estate business become regulated - it may also provide portfolio management services as a delegate pursuant to AIFMD and for this reason it would also need to become regulated. In addition, the Luxembourg entity is set to become regulated under AIFMD and the preparation is currently underway to comply with the Directive. The role will require the successful candidate to set up the processes for regulating the business in Europe and then once regulated to support the regulatory interface and meet all ongoing regulatory requirements for the European Real Estate business. The function is divided into Regulatory (interpretation and implementation of regulations)and Monitoring (monitoring of compliance with regulations).

Key Responsibilities / Duties:

  • Support the establishment of a regulated AIFM in Luxembourg and MiFID company in Munich ensuring sufficient and optimal regulatory structure is in place for the European Business
  • Advise management on general compliance issues / regulatory changes and the impacts of them on the IRE business in Europe
  • Formulate monitoring plan and undertake monitoring reviews to ensure compliance with relevant regulation
  • Identify gaps and provide assistance to achieve compliance and/ or best practice. Report on errors, breaches and complaints. To identify and monitor compliance risk areas of the business and initiate corrective action for avoidance of future breaches
  • Financial promotions: providing Marketing and Distribution support for compliance with local regulatory requirements in promotions. Provide Compliance support for RFPs
  • Provide project support for regulatory and business change
  • Reporting to management including relevant boards, committees and forums
  • Liaise with other Compliance and Real Estate functions across the business to support the Real Estate business in Europe including regulatory communication, audit and other internal and external parties as necessary
  • Provide regular Compliance and Financial crime training and other trainings on relevant regulatory changes
  • Liaise with internal and external auditors, service providers, industry associations where necessary

Work Experience / Knowledge:

  • Minimum 5 years' experience in the Real Estate finance industry
  • Proven knowledge of real estate businesses, real estate funds and regulatory requirements across European markets in particular Germany but also UK &, Luxembourg and France

Skills & Other Personal Attributes Required:

  • Computer literate (esp. Excel skills)

Formal Education: (minimum requirement to perform job duties)
